When to File and Pay New York Estate Tax
Like all taxes, there are rules, time limits and forms for completing estate tax returns in New York. An estate has nine months after the date of death to file a New York estate tax return.
The estate must File Form ET-706 which is the New York State Estate Tax Return. The personal representative may be responsible for filing the estate tax return, unless the decedent has appointed someone else to take care of the taxes and the estate administration.
Extensions for Filing and Paying New York Estate Tax
An estate may file for an extension to file return as well as for paying the tax, but in order to get an extension, the estate must file an Application for Extension of Time to File and/or Pay Estate Tax. Form ET-133 is the application. The time to file may only be extended by an additional six months. In situations where an estate will suffer an undue hardship in order to pay estate taxes, the estate may get an extension of up to four years to pay.
